- Attached propertyIn DAILYNEWS·22 जून 2020Rahul Kushwaha Advocate High court Allahabad Contact-9452714702 सम्पत्ति का कुर्क होना :------ ज्यादातर लोग नियम और कानूनों के बारे में नहीं जानते और सरकारी कर्मचारी एवं अधिकारी आम जनता की इसी अज्ञानता का फायदा उठाते हैं। यदि किसी दोषी व्यक्ति की संपत्ति नियम अनुसार कुर्क होनी चाहिए परंतु जिम्मेदार अधिकारी/ कर्मचारी अपने पद का दुरुपयोग करते हुए संपत्ति कुर्की की कार्यवाही को प्रभावित कर देता है तो सामान्यतः लोग उच्च अधिकारियों के पास शिकायत लेकर जाते हैं और उनकी शिकायत फाइल दर फाइल घूमती रहती है लेकिन यदि वह एक याचिका लेकर कोर्ट में जाएं तो कोर्ट के आदेश पर संबंधित थाने में उनके खिलाफ आईपीसी की धारा 217 218 के तहत आपराधिक प्रकरण दर्ज किया जा सकता है। भारतीय दण्ड संहिता,1860 की धारा 217 एवं 218 की परिभाषाऐ:- (1). धारा 217 की परिभाषा सरल शब्दों में:- जो कोई लोक-सेवक अपने कार्य कालीन कर्तव्य के अनुपालन में इस आशय से किसी व्यक्ति को विधिक दण्ड या उसकी संपत्ति को जब्ती होने से बचाने के लिए विधि के किसी निर्देश को नहीं मानेगा या अवहेलना करेगा। वह लोक-सेवक इस धारा के अंतर्गत दण्डिनीय होगा। (2). धारा 218 की परिभाषा सरल शब्दों में:- अगर कोई लोक-सेवक जानबूझकर किसी व्यक्ति को संपति की कुर्की या जब्ती से बचाने के उद्देश्य से झूठे दस्तावेज की संरचना करेगा या लेख, रिपोर्ट आदि को गलत ढंग से तैयार करेगा। वह लोक-सेवक इस धारा के अंतर्गत दोषी होगा। भारतीय दण्ड संहिता की धारा 217 एवं 218 में दण्ड का प्रावधान:- (1). धारा 217 :- इस धारा के अपराध असंज्ञेय एवं जमानतीय होते हैं।इनकी सुनवाई किसी भी मजिस्ट्रेट द्वारा की जा सकती है। सजा- दो वर्ष की कारावास या जुर्माना या दोनो से दण्डित किया जा सकता है। (2). धारा 218 :- इस धारा का अपराध संज्ञये एवं जमानतीय होते है।इनकी सुनवाई प्रथम श्रेणी के मजिस्ट्रेट द्वारा की जाती है। सजा- तीन वर्ष की कारावास एवं जुर्माना या दोनों से दण्डित किया जा सकता है। उधारानुसार वाद:- सम्राट बनाम मोहम्मद शाह खान- पुलिस स्टेशन में डकैती के अपराध की रिपोर्ट की गई।प्रभारी पुलिस अधिकारी ने उक्त रिपोर्ट ले ली परन्तु बाद में उसे विनष्ट कर उसकी जगह किसी और ही अपराध की रिपोर्ट तैयार करके उस पर शिकायतकर्ता(आवेदक) के हस्ताक्षर ले लिए ओर उसे मूल रिपोर्ट के रूप में अगली कार्यवाही में प्रयुक्त किया।उसने ऐसा वास्तविक अपराधी को अधिक दण्ड से बचाने के उद्देश्य से किया था। अतः न्यायालय द्वारा धारा 204(दस्तावेज नष्ट करना) के साथ पठित धारा 218 के अंतर्गत दोषसिद्ध करके दण्डित किया गया।4164
